Potential Pitfalls of Buying Overseas Properties
When considering an overseas property purchase, you need to be aware
of the pitfalls awaiting unsuspecting and trusting buyers, in a very competitive, and at times, unethical marketplace.
There are frequent press articles about people who have experienced problems such as;
Land-Grab Legislation
Buying houses with
land, only to find that arbitrary land grab legislation takes their land away from them. This has left many Britons
financially destitute, and in some instances resulted in the loss of their homes.One case that we are aware of was
when a very well known property agent (who run constant exhibitions, national newspaper advertising and have a strong
internet presence,) knowingly sold such a property to an unsuspecting British couple, knowing they would face hefty
financial penalties for such a purchase. The most disturbing aspect of this case, was the fact that when challenged by
the purchasers, the agent then offered to sell it on for no commission!
Inspection Visits
High profile television and media marketing campaigns
enticing people to buy overseas property are, more often than not, accompanied by the offer of inspection visits. These are notionally intended for you to see desirable property developments
in a relaxed and non pressured environment. In reality nothing could be further from the truth.
The normal procedures are;
- You will be met at the airport by a
representative of the company.
- So far, so good. However, from this point on you will be
controlled at all times.
- Once at your hotel, unless very late at night or very early morning, you will be in the
bar for complimentary drinks. They will be with you constantly.
- There is very little time, other than in bed, to consider and evaluate what you have seen, to be able to make
an informed decision as to a purchase.
- You
will be told there are only one or two available properties, once you show any interest in a particular development.
- The sole aim of the representative is to get
the sale. This involves a credit card payment of between £2,000
and £ 4,000 for the reservation. If the representative fails to achieve this, they have to explain to superiors
why they have failed to close the client.
- Some companies levy financial penalties on employees who do this.
We have to be aware of the fact that these property companies are only concerned with how much money they can
make, and are not interested in satisfying the clients requirements and needs.
- Unfortunately
this is particularly the case with new developments. Perhaps, this explains the abundance of former timeshare and
double glazing people in this business!
Completion without Lawyers
As unbelievable as it may seem, a large majority of
purchases in Spain are completed without independent legal advice. The
majority of property companies do not even mention a solicitor. If
asked, they explain that this is taken care of in house. Of course, this suits them, as they are able to cover their
own bad practices. All the protection afforded by a truly independent lawyer is lost.
